Fly Hosts was formed in September 2006 to set a new standard for shared and reseller hosting. To realize this goal.
* We do not allow Child Pornography, IRC Bots, Peer to Peer sites , Torrent Sites , or any file sharing type sites.
* You may not store more data in your account than your allotted server space..
* Your server space and ftp account is for your personal use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people. If your password is let out to others, its not our responsibility for any action taken on your account.
* Illegal Activities: Flyhosts.net services may not be used for illegal purposes, or in support of illegal activities. DedicatedNow reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.
* Unsolicited E-mail, News Bombing (SPAM) Use of flyhosts.net service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Spam complaints will be sent to the e-mail address on file. Violations of this type will result in the immediate suspension of the offending website on the Flyhosts servers. Failure to respond to complaints within a 24 hour timeframe will result in Flyhosts suspending the offending website or shared hosting account by whatever means necessary.
* Copyright or trademark infringement: Use of Flyhosts.net service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software. Use of the DedicatedNow service to collect, or attempt to collect, personal information about third parties without their knowledge or consent. Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. * Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your web space.
* You may not run server processes (eg. talkers/IRC Bots) from your web space. We will terminate/suspend accounts those who do run server processes with or without prior notice.
* We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
* When your account is closed, all files (including web pages, etc.) will be deleted.
* We reserve the right to amend and update these Terms and Conditions at any time without prior notice.
* To protect your privacy we never distribute your name, e-mail address, confidential information like credit card info., etc to any third parties.
* Users must not participate in any form of un-solicited bulk e-mailing or spam. We will terminate/suspend accounts those who indulge in such activities with or without prior notice.
* By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions whether you have read this or not.

Bandwidth

* Fly Hosts operates a fair use policy and therefore offers unrestricted use of bandwidth on some servers only. However, should your bandwidth reach the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage. Web Pages

* Commercial/Business use of web and ftp space is permitted.
* You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK/US/ any country's law.
* You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
* We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. Fly Hosts do not allow child pornography or IRC bots on their servers.

Cancellation and Refunds

* If you take out one of yearly packages we expect you to commit for this period of time. Because of your commitment, we offer a discount on the normal monthly price of our accounts. If you cancel your account within your service period then Fly Hosts will not make any refunds on any unused portions of your account. While we do not offer refunds for pro-rated service you have no obligation to continue using our service.
* Fly Hosts reserves the right to cancel the service at any time. Customer refund requests are to be sent to support@flyhosts.net and will only be processed in the cases of service non-performance where Fly Hosts is clearly at fault. Refund requests for problems beyond Fly Hosts control will be refused.
* For example:
- Domain transfer failure.
- Failure of any third party script or program that's not supported by Fly Hosts.
- A customer's lack of experience in dealing with web basics, computer programming and communication protocols.

Indemnification

* Customer agrees that it shall defend, indemnify, save and hold Fly Hosts harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against Fly Hosts, its agents, its customers, officers and employees, advertisers, affiliates, hosts, etc that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Fly Hosts against liabilities arising out of:


(1) Any injury to person or property caused by any products sold or otherwise distributed in connection with Fly Hosts server, service or any product.
(2) Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) Copyright infringement.
(4) Any defective products sold to customer from Fly Hosts server.



MP3/Video Files

* Customer agrees that no MP3 files are to be stored on Fly Hosts servers without permission from copyright holders, certain exceptions are:


(1) Customer must own copyright of all files stored on the server,
(2) Any file which customer does not own copyright must be permitted to be stored on the server first,
Or
(3) Files must be released under the GPL license.

Anyone found to store files that they do not have permissions from the copyright owners will immediately be removed from the server and the proper authorities will be informed.

Disclaimer

Fly Hosts will not be responsible for any damages your business may suffer, Fly Hosts makes no warranties of any kind, expressed or implied for services we provide. Fly Hosts disclaims any warrantor merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by Fly Hosts and its employees.

Fly Hosts reserves the right to revise the above terms and conditions at any time without any kind of notification. All Terms and Conditions will take effect as soon as it is published on this web page.
